The House of Lords has upheld the European Court of Justice’s earlier ruling that staff on long-term sickness absence do accrue paid holiday for their entire sick leave, and must be allowed to take it on their return or be paid in lieu of it if their employment ends

Under breach of contract law, the House of Lords’ decision means that workers who have previously been denied such pay can also claim for unauthorised deductions from wages as far as six years back.
